1. AGREEMENT TO TERMS

By registering to receive and access the free downloadable guide (the “Guide”) and the Adwizar.ai portal through which it is delivered, you agree to be legally bound by these Terms of Use, our Privacy Policy, our Text Message Policy, and any additional terms referenced herein. If you do not agree, do not access the Guide, the portal, or submit your information.

2. LICENSE TO ACCESS

You may opt out at any time by replying “STOP” to a text or contacting [email protected]. Standard message and data rates may apply. You also agree to our full Text Message Policy.

6. PRIVACY POLICY

By registering for the Guide and portal access, you agree that Bluestar Brandz, Inc. may collect, use, and share your personal data (including name, contact information, and engagement activity) with our affiliated companies, marketing partners, service providers, and other authorized third parties for purposes including business development, promotional campaigns, operational services, and content delivery. We do not knowingly collect data from individuals under the age of 13. By registering, you acknowledge and agree to the full terms of our Privacy Policy and Text Message Policy, which are incorporated herein by reference.

7. WAIVER OF LIABILITY

You acknowledge and agree that your access to and use of the Guide and portal is entirely voluntary and at your own risk. Bluestar Brandz, Inc., its officers, directors, employees, agents, and affiliates shall not be liable for any claims, damages, losses, or causes of action, whether in contract, tort, or otherwise, arising out of or related to your participation, including but not limited to personal injury, emotional distress, or financial loss. You voluntarily waive and release any and all claims against Bluestar Brandz, Inc. related to your access and use of the Guide or portal.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Bluestar Brandz, Inc., its affiliates, officers, directors, agents, employees, and contractors from any claims, demands, liabilities, losses, damages, or expenses, including reasonable attorneys’ fees, arising out of or connected to your access or use of the Guide or portal, your violation of these Terms, or your infringement of the rights of any third party.

9. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles.

Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to these Terms, the Guide, or the portal shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The arbitration shall be conducted in Los Angeles, California, before a single arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

No Class Actions: You agree that any arbitration or proceeding shall be limited to the dispute between you and Bluestar Brandz, Inc. individually. To the fullest extent permitted by law:

- No arbitration or proceeding shall be joined with any other;

- There is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures; and

- You may not bring any claim or dispute in a purported representative capacity on behalf of the general public, other users, or any other persons.

By agreeing to these Terms, you waive any right to a jury trial and agree to resolve all disputes through individual arbitration seated in Los Angeles, California, with Florida law governing the interpretation and enforcement of this Agreement.

Severability: If any part of this arbitration provision or class action waiver is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

10. MODIFICATION

We reserve the right to update these Terms at any time. Continued access or use of the Guide or portal after updates constitutes your agreement to the revised Terms.

11. TERMINATION

We may suspend or terminate your access to the Guide or portal at our discretion without prior notice.

12. ELECTRONIC CONSENT

By clicking “DOWNLOAD,” “SUBMIT,” or any similar button, or by otherwise indicating consent, you provide your legally binding electronic signature and agree to these Terms. This satisfies the requirements of the Electronic Signatures in Global and National Commerce Act (ESIGN) and similar laws.

13. EARNINGS DISCLAIMER

No guarantees are made about income or success from using the Guide or accessing the portal. Testimonials shared are not indicative of typical results.
